Public offer agreement for the provision of tourist services

This document is an official public offer by OKS TOURS (hereinafter — the “Company”, the “Contractor”) to conclude an agreement for the provision of tourist services on the terms set out below with any individual or legal entity (hereinafter — the “Customer”). Placing an order on okstours.com and/or making payment constitutes full and unconditional acceptance of the terms of this offer in accordance with Article 370 of the Civil Code of the Republic of Uzbekistan.
1. General Provisions
• Contractor: OKS TOURS — a licensed tour operator of the Republic of Uzbekistan. The license is issued by the Ministry of Tourism and Cultural Heritage of the Republic of Karakalpakstan. • Legal address: Khorezm region, Urgench, Khanka Street 36. • This offer is published on okstours.com and remains in force until revoked by the Contractor. • The Company may amend this offer unilaterally. The new version takes effect from the moment of its publication on the website. • The parties' relations are governed by the laws of the Republic of Uzbekistan.
2. Subject of the Offer
• The Contractor undertakes to provide the Customer with tourist services (the “Services”) selected on okstours.com: tour packages, hotel bookings, transfers, excursions, visa and insurance support. • The Customer undertakes to accept and pay for the Services on the terms set out in this offer. • The full list, description and cost of the Services are specified in the respective tour cards and other sections of the website. • Prices are denominated in US dollars or Uzbek soums. When paying in a different currency, the Central Bank of the Republic of Uzbekistan exchange rate on the day of payment applies.
3. Order Placement Process
1. The Customer selects a tour or service on okstours.com and completes the booking form, providing accurate contact details, the composition of the group and the travel dates. 2. Upon receiving the request, the Company sends the Customer a confirmation of availability and the final price by email or through a manager. 3. The Customer confirms the booking and proceeds to payment using any of the available methods. 4. After receiving payment, the Company sends the Customer a voucher and the documents required for the trip. 5. A booking is considered confirmed only after the Company has received payment (in full or as a prepayment, depending on the conditions of the specific tour). 6. The Customer is responsible for the accuracy of the information provided. The Company is not liable for the consequences of errors made by the Customer when placing the order.
4. Bank Card Payment
• Online payments are accepted with Visa, MasterCard, Uzcard and Humo cards. • Payments are processed by Freedom Payments JSC (freedompay.uz) — a PCI DSS-certified payment provider authorised by the Central Bank of the Republic of Uzbekistan. • After confirming the order, the Customer is redirected to a secure Freedom Pay page where they enter their card details (number, expiry date, CVV/CVC, cardholder name). • Card details are transmitted directly to the Freedom Pay processing center over a secure channel (TLS) and are not stored on OKS TOURS servers. • Transactions are additionally protected by the 3-D Secure protocol (Verified by Visa, MasterCard SecureCode) — the issuing bank may request a one-time confirmation code. • Payment is deemed completed when OKS TOURS receives a positive response from the processing center. An electronic receipt is sent to the Customer. • If a transaction fails, the Customer may retry the payment or contact a manager. Failed transactions are not charged to the card, or are automatically reversed by the bank.
5. Refund Rules
• Refunds are issued to the same bank card used for the original payment, in the currency of that payment. • A refund request is submitted in free form to info@okstours.com, stating the order number, payment date and reason for the refund. A copy of the cardholder's identity document must be attached. • The request is reviewed within 10 business days from receipt of the complete set of documents. • Funds are credited to the Customer's account within 3 to 30 calendar days depending on the issuing bank. • The refund amount is determined in accordance with the cancellation terms set out below and may be reduced by banking and payment processing fees where provided for in the agreement with the payment provider. • Since tourist services are not a physical good, the rules for returning goods of proper quality do not apply: refunds are processed on the basis of termination of the service agreement.
6. Order Cancellation
The Customer may cancel a booking at any time by sending written notice to info@okstours.com. The refundable amount depends on how far in advance of the service start date the notice is given: • More than 30 days before the tour — 100% refund (less actual costs incurred and banking fees). • From 15 to 30 days — 70% refund. • From 7 to 14 days — 50% refund. • Less than 7 days before the tour — no refund. • No-show without notice — no refund. The Contractor may cancel or reschedule a tour in the event of force majeure, insufficient group size or other circumstances beyond its control. In such cases the Customer is offered a date change, an alternative tour, or a 100% refund at the Customer's choice.
7. Special Promotions
• The terms of special promotions, discounts and promo campaigns are published on the relevant website pages or tour cards and are valid only for the promotion period. • Promotional prices and discounts do not combine with other offers, bonuses or promo codes unless expressly stated otherwise. • The number of seats or tours at the promotional price may be limited. Priority is given to orders received and paid for earlier. • Promotions may exclude certain dates (holidays, high season), certain room categories, partner services and group bookings. • The Company reserves the right to amend or terminate a promotion early, with prior notice published on the website. Confirmed bookings made before the change remain valid on the original terms. • Refunds for promotional bookings follow the cancellation rules in effect on the payment date.
8. Payment Security and Data Protection
• All online payments are processed through PCI DSS-certified Freedom Pay infrastructure. The Attestation of Compliance (AoC) and the PCI DSS merchant certificate are provided by the payment service provider. • Full card details (PAN, CVV/CVC) are never transmitted to or stored by OKS TOURS. The Company receives only the transaction reference identifier and its status. • Data is transmitted over a TLS-encrypted channel. Transaction authorisation is protected by 3-D Secure. • Personal data is processed in accordance with the Privacy Policy published on the website. • If fraud or unauthorised card use is suspected, the Customer must immediately contact the issuing bank and OKS TOURS.
9. Final Provisions
• This offer is an adhesion contract: by accepting it, the Customer confirms that they have read and agreed to all of its terms. • All disputes not resolved through negotiation shall be settled in accordance with the laws of the Republic of Uzbekistan, in courts located at the Contractor's place of business. • The parties are released from liability for non-performance caused by force majeure: natural disasters, epidemics, military actions, acts of government authorities, border closures and other circumstances beyond the parties' control. • If any provisions of this offer are found to be invalid, this does not affect the validity of the remaining provisions. • The current version of the offer is always available at okstours.com/en/offer.
